These terms and conditions (Terms) apply to and govern “Webfare Awards” organized and conducted by Kadmus Entertainment (“Kadmus”)

By accessing this site ‘www.webfareawards.com’ and participating in the Awards, you (You, Your, User) agree to have read, understood and to be bound by these Terms. Kadmus reserves the right to modify these Terms without any prior notice. You are advised to regularly view and access these Terms. If you do not agree with any of the Terms and any amendments thereto, you must not use this site/service or participate in the Awards. Kadmus shall mean and include its affiliates, group companies, Awards partners, Awards sponsors, knowledge partners, process partners, its agents, representatives, its employees, officers, directors.

Personnel from Kadmus or appointed / engaged by Kadmus who are responsible for the conduct of the Awards.

Participant

Any content creator/producer/performer of any eligible show, channel, series of any eligible show, individuals or organization that sends in an application to participate in the awards as per the terms & conditions in the awards.

Screening Jury

Group of persons appointed / engaged by Kadmus to select the finalists

Grand Jury

Group of persons appointed / engaged by Kadmus to select the winners.

Terms

These terms and conditions governing the Awards, as amended from time to time.

  • These terms & conditions, are applicable to and govern the “Webfare Awards” organized and conducted by Kadmus.

  • By participating in the awards, participant agrees to abide by and be bound by these terms. These terms & conditions may be modified without any prior notification. Participant is advised to regularly review these terms. If there is any disagreement with any of the terms & conditions and any amendments thereto, participant must not participate or withdraw application from the awards.

Awards Objective

Webfare Awards proposes to honor original content released in India which are created and exhibited or exploited on, the internet and to recognize those pioneering companies and individuals who create, produce, and perform in these productions.

Direction

  • An individual/s who is in charge of the activities involved in directing a web series, or section of a web-series.

  • They are generally responsible for decisions about the editorial content and creative style of a web-series, and ensuring that the producer’s vision is delivered.

5.

Performance in a Supporting Role – Male

An actor who performs a role of a second lead in a web-series.

6.

Performance in a Supporting Role – Female

A female actress who performs a role of a second lead in a web-series.

7.

Cinematography

A cinematographer or director of photography is the chief over the camera and light crews working on the web series and is responsible for making artistic and technical decisions related to the image.

8.

Story

An individual/s who is responsible writing the web-series with the most innovative and interesting story line.

9.

Screenplay

  • An individual or a group of screenwriters who have carried out the screenplay of the web series.

  • The content needs to be original and not an adaption from existing pieces of writing.

10.

Dialogues

An individual or a group of writers responsible for writing the dialogues for a web series.

11.

Editing

An individual who is responsible for assembling, recording raw material into a finished product that's suitable for broadcasting. The material may include camera footage, dialogue, sound effects, graphics and special effects.

Web Films – Short films and Feature films (All the sub-categories will have 2 awards in one for short film and feature film)

1.

Web Film of the Year – Short film and Feature film

A film that released and distributed on the internet. Web film has been sub-categorized into the below two sub-categories :

  1. Short film – Any film the duration of which, ranges from 90 seconds to 40 minutes(including start and end credits)

  2. Feature film – Any film, the duration of which is more than 40 minutes(including start and end credits)

Performance in a Leading Role – Male

A male actor who plays the role of the central character in the web film.

3.

Performance in a Leading Role – Female

A female actor who plays the role of the central character in the web film.

4.

Direction

An individual/s who is in charge of the activities involved in making a web series, or section of a web-film.

5.

Performance in a Supporting Role – Male

An actor who performs a role in a play or film below that of the leading actor(s).

6.

Performance in a Supporting Role – Female

An actor who performs a role in a play or film below that of the leading actor(s).

7.

Cinematography

A cinematographer or director of photography is the chief over the camera and light crews working on the web film and is responsible for making artistic and technical decisions related to the image.

Story

An individual/s who is responsible writing the web-film with the most innovative and interesting story line.

9.

Screenplay

  • An individual who acts as a screenwriter and carries out the screenplay of the web film.

  • The screenplay needs to be original and not an adaption from existing pieces of writing.

Dialogues

An individual who acts as a dialogue writer and writes the dialogues for the web film.

11.

Editing

An individual who is responsible for assembling, recording raw material into a finished product that's suitable for broadcasting. The material may include camera footage, dialogue, sound effects, graphics and special effects.

Web Music/Dance

1.

Song of the Year

Awarded for a single or one track from a web series/web film or sung independently by an artist and is released between the defined period.

2.

Male vocalist

Awarded for a single or one track from a web series/web film or sung independently by an artist and is released between the defined period.

3.

Female vocalist

Awarded for a single or one track from a web series/web film or sung independently by an artist and is released between the defined period.

4.

Music Director

An individual or group of individuals who composes the songs in a web series/ web film.

5.

Group Dance

Acts performed by groups of people simultaneously, as opposed to individuals dancing alone or individually, and as opposed to couples dancing together but independently of others dancing at the same time.

6.

Solo Dance

Act performed by an individual dancing alone, as opposed to couples dancing together but independently of others dancing at the same time, if any, and as opposed to groups of people dancing simultaneously in a coordinated manner.

7.

Duet Dance

Acts performed by couples or any two people as opposed to group dances or solo dances in a coordinated manner.

Web Gigs

1.

Gig of the Year

Awarded to a series that involve live performances by individual or group of comedians on the same stage.

2.

Stand-up comedian of the Year – Male

An individual commonly known as a comedian who performs in front of live audience, usually speaking to them directly.

3.

Stand-up comedian of the Year – Female

An individual commonly known as a comedian who performs in front of live audience, usually speaking to them directly.

Brand Integration

1.

Brand Integration of the Year – Web series

The innovativeness of integrating the brand with the web series.

2.

Brand Integration of the Year – Short Films

The innovativeness of integrating the brand with the short film.

3.

Brand Integration of the Year – Gigs

The innovativeness of integrating the brand with the gigs.

4.

Brand Integration of the Year – Music Albums

The innovativeness of integrating the brand with the music album.

  • The Award categories may be changed / modified / split / merged / increased or cancelled by the awards management based on the number of entries received in each category, and the quality of the entries.

  • In the event that there are no participants in a category are found to be worthy of inclusion by the Screening Jury or the Grand Jury, the award categories may be cancelled. The Jury may decide to add nominees in the category to maintain high standards of participation. The decision of the Jury in this regard will be final. The awards management will not entertain any queries in this regard.

Eligibility criteria for the awards:

  • Participants applying for Webfare Awards 2018 should be Indian registered entities or foreign entities with a registered presence in India. Appropriate documentation will be furnished for authentication if requested.

  • Organizations applying for the awards must have completed at least 2 years of operations in India as on September 30, 2018. Appropriate documentation will have to be furnished for authentication if requested by the awards management or jury.

  • An “Eligible Program” must have been initially released or exploited via the Internet (i.e., first public or private exhibition occurred via a video sharing site or unique URL) between 1st April, 2017 to 30th October, 2018.

  • An individual participating in the awards must have completed 18 years of age as on September 30, 2018. Appropriate documentation will be furnished for authentication if requested.

  • Web-series/films/music/gigs/dance/content etc which has premiered and/or first released, distributed, or exhibited on internet are eligible to apply of the awards.

  • If the content submitted for the awards is premiered or explored any other media before releasing it on internet, whether before, during, or after the eligibility period, will not be allowed to apply for the awards.

  • Content submitted for the awards in regional languages must be dubbed or subtitled into Hindi/English. Any regional language entry which is not dubbed or subtitled into Hindi will be disqualified.

  • The following types of productions or materials are not eligible for consideration, whether or not they were originally created for or exploited on the internet:

    • Previews

    • Trailers

    • Sizzle Reels (such as demo reels, show reels, public relation videos).

    • Commercials except for the ‘Campaign’ categories.

    • Sequences from feature-length films intended for theatrical distribution or home video release.

    • Episodes of established television series previously delivered on broadcast, pay, or cable television; provided.

    • Dance tutorials

  • Entries are subject to review and those deemed inappropriate, offensive or discriminatory will be disqualified. This includes, but is not limited to, pornography, racial slander, and defamatory statements. The final decision of eliminating these content will rest in the hands of the jury members.

  • Evidence for date of release of the eligible program needs to be provided along with the entry online. In case of absence of the document the entry will be disqualified from the awards.

  • To be eligible for the performance award categories, the individual(s) must have performed in an eligible program.

  • Programs will be considered in the form that they appear online during the eligibility period and must remain posted online and available for public review at a specified URL or Web page during the review period ( April 01, 2018 to March 2019).

  • An organization cannot participate on behalf of its sister units; parent organization or other organizations under the parent organization.

  • If, multiple entries are received from different participants, then the final decision rest with the production house/ content owner to decide who would be the rightful winner. The awards management or any of its partners will not be involved in deciding the same.

  • The recipient of the award will be the participant who has applied for the award.

  • Employees and immediate family members of sponsors and partners of the awards are not allowed to participate in the awards.

  • The video sharing site or unique URL should have been created for public viewing and not for purpose of the award. Any such entry received will be disqualified.

  • The final eligibility of Participants will be subject to the discretion and approval of the Jury.

  • The Jury may modify the eligibility criteria from time to time with retrospective effect.

  • The Jury holds the right to disqualify, categorize, scrap any entry/category/categories which does not meet the eligibility criteria without assigning any reason whatsoever.

Call for entries

  • Applications may be submitted by individuals/production house should be associated with the content submitted during the call for entries period as mentioned on the website.

  • The call for entries for the awards will be announced in one or more relevant edition(s) of newspapers or by indirect / direct communication with potential participants, and that shall be construed to be adequate notice for call for entries.

  • Participants applying under any category (apart from web series) should submit only a single entry link containing one episode of the program.

  • For web series the participants need to be submit all the episodes of the season. The participants need to mandatorily rank their top 5 episodes in the application form.

  • Participants applying in the web film category should keep the following criteria in mind:

    • The duration of a short film including start and end credits should be between 90 seconds to 40 minutes
    • The duration of a feature film including start and end credits should be more than 40 minutes

  • Participants applying in the Web Music & Dance category should keep the following eligibility criteria in mind :

    • Minimum duration of a song is of 1 and half minute.
    • Minimum duration of solo dance of 1 and half minute.
    • Minimum duration of group dance should be 2 and half to 3 minutes.
    • Minimum duration of a duet dance will should be 2 and half minutes.
    • A group dance should have a minimum of 5 members in the group to qualify for the awards.

  • For Brand Integration category the participant should submit only clips from the series/film/gig/song where the brand has been displays.

  • Participant can apply for the Awards by submitting the details on the website www.webfareawards.com

  • Participant can participate in multiple Award categories provided each entry is for a different show/series/compilation.

  • Participant can apply multiple times in the same award category provided that each entry is for a different show/series/compilation.

  • The Jury has the right to reclassify application forms from one category to another, at its discretion.

Receipt of Entries

  • All entries must be submitted on the website www.webfareawards.com

  • Receipt of application forms after last date of receipt specified may be permitted only at the discretion of the Awards Management

  • The verification link shared with the client will be valid until 5th December, 2018. Participants are responsible for persuading the client in order to verify the link.

  • Jury will have the right to disqualify an entry if it does not receive verification from the client within 1 week of closure for the call for entry.

  • In case a participant submits more than one URL in any category apart from Web series, the awards management shall take into consideration the first mentioned URL and shall not consider any other URL mentioned thereafter.

  • In case a participant submits more than 5 URLs for web-series, the awards management shall take into consideration the first 5 mentioned URL and shall not consider any other URL mentioned thereafter

  • It is mandatory for the participants applying in the web series categories to rank the top five episodes from their web series.

  • Awards Management will not be responsible for application forms that are damaged / lost / not submitted due to lack or lapse in any communication on account of internet failure

  • Participation in the Awards in any manner will be construed as an acceptance to the Terms and conditions stated herein

Selection process

  • If a client of a particular web series/film/music/gigs does not respond with an approval email on the verification email that is sent to him within a week of submission, then the application stands disqualified

  • The timeline for receiving the email verification from the client shall be extended only at the discretion of the awards management. The awards management shall not be held responsible if the timelines are not extended.

  • The finalists will be selected by the Jury/Panel members on pre-defined parameters

  • Participants will be notified on contact details mentioned on the application form only, by the Awards Management on best effort basis by any means deemed appropriate

  • The decision of the Jury/Panel for selection of the nominees/winners shall be final and binding on participants

  • Participant may be contacted for any additional information may be undertaken to verify the information provided

  • Kadmus will use reasonable efforts to keep confidential the information provided by the participant and shall use it for the purpose of evaluating the participant’s entry for the Awards and such other purpose

  • If, in the opinion of the Jury/Panel, no Eligible Programs meet the Webfare Awards’ standard of excellence for a particular Award, Awards Management may, in its sole discretion, cancel the applicable Award

  • If a submission is not available for review by the Panel during the Review Period at the link or URL provided in the application form, then such submission shall be disqualified

Instructions for submitting the entry

  • A participant can apply for the Awards by logging on to the website www.webfareawards.com and completing the form along with the supporting documents directly on the website

  • A participant has to use one application form for one entry only. For multiple entries, the participant will have to use to multiple forms.

  • Each category has a prescribed set of documents to be submitted as proof. You are required to attach the prescribed set of documents (in soft & hard copy) pertaining to the period as mentioned in the form.

  • All mandatory information must be answered. Incomplete entries may not be considered.

  • It is mandatory for the participant to provide a maximum of one link for all categories(except for web series).

  • For web series category participant needs to provide the link with all the episodes for the evaluation process.

  • It is mandatory for the participants applying in the web series categories to rank the top five episodes from their web series.

  • All entries must be accompanied by the name of the person(s) who will be accepting the award if the Participant/nominee is chosen as the Winner.

  • It is mandatory for the participant to provide a valid email id of the producer to whom a verification email will be send to verify the information provided by him in the application form failing which his/her application shall not be considered

  • Awards management will not be responsible for disqualification of entries due to lapse of communication caused by an incorrect client email id provided by the participants.

  • Awards Management will not be responsible for any entries, nominations due to lapse in any communication on account of internet failure.

Timelines

  • All Applications must be submitted on the website only. Applications submitted through any other medium/mode shall not be accepted

  • Efforts will be made to adhere to the defined timelines. However, the defined timelines are subject to change based on circumstances. Awards Management and its sub-contractors shall not be held accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Awards or its ceremony or any part of its processes or on account of any factors beyond its control..

Completeness of Entries/ Disqualification

  • All mandatory fields of the application form needs to be complete in all respects; else it may be disqualified from participation.

  • Entries will be accepted in English language only.

  • If at any time, during the Awards process or post the Awards, any information provided by any Participant is found to be incorrect in any manner, then the Participant will be disqualified from the Awards

  • If at any time, any information provided by any Participant is found to be incorrect in any manner, then Jury reserves the right to disqualify such participant

  • Disqualification of entries is at the sole discretion of Jury.

  • Kadmus and/or Kadmus Partners their sub-contractors shall not be held accountable / liable for any disruptions, stoppages, interruptions, delays, closure or cancellation of the Awards or any part thereof or final gratification or any part of its processes or due to any reasons or on account of any factors beyond its control and/or due to force majeure

Additional Information

  • Participants may be contacted for any additional information to verify the information provided. Such information sourced from the Participants will become part of the original entry

  • Awards Management has the right to ask for documentary proof of information. If such a request is made and the Participant does not comply within 3 working days from the date the request is made, the Participant may be disqualified from participation in the Awards

  • Awards Management or team appointed by Awards Management will try to contact the Participant on best effort basis by any means deemed appropriate.

  • In the event it is not possible to contact any Participant to obtain information on them, interview them, etc. such Participant may be disqualified from further participation.

  • The participant hereby irrevocably authorizes the Awards Management to use the data gathered during and/or the Awards in respect of the participants. This shall be the property of KADMUS and Kadmus shall be entitled to use the same in its communications including marketing promotions and advertisements along with/without Kadmus’ s brand.

  • Awards Management shall not be liable in any manner for any mishap, accident, injury or damages etc. of whatsoever nature, caused to the participants during the Awards

  • Further, Awards Management shall not be liable in any manner for any loss, damage, theft, or any other mishap caused during the Awards.

Validity and Correctness of Information

  • If at any time, including after the conclusion of any of the Award ceremonies, any information provided by any Participant(s), is found to be incorrect in any manner, then the Participant will be liable to be disqualified and / or return the Award. Awards Management may also take penal action against the Participant for providing false information to participate in the Awards

  • Determination of whether information provided as fair and accurate rests with the Jury and Awards Management.

General

  • Participant agrees that the Participant is legally capable of entering and, if selected, participating in the Awards and agree to the Terms and that Participant is competent (i.e.

  • Participant are of legal age and mental capacity) and eligible to enter into this legally binding agreement on Participant.

  • Participant understands and agrees that merely participating in these Awards does not entitle the Participant to a prize or to any other form of consideration.

  • Participant warrants and represents to the Awards Management that all information including any communications, software, photos, text, video, graphics, music, sounds, images and other material submitted or recorded in any manner by the Participant or the partners of Awards Management including Awards Management for consideration for the Awards are solely owned by the Awards Management and do not infringe upon any other individual or organizational rights (including, without limitation, intellectual property rights). Participant shall be completely responsible for handling any infringement or alleged infringement and shall indemnify the KADMUS and Kadmus Partners (in India or abroad), and the Awards Management from any claims, costs or damages from infringement or alleged infringement of the logo or trademark or the defense of a claim or any costs payable thereof.

  • Participant must enter the Awards at their own will and the Awards Management are not in any way obligated or liable for any loss or costs that the Participant may suffer or incur and nothing is payable to the Participants for participating in the Awards or any event prior to or following the Awards.

  • Participants for the purpose of entering the Awards, automatically grants KADMUS a royalty-free, irrevocable, worldwide, non-transferable, non-exclusive right and license to use and display such entry, for participation in the Awards, and any intellectual property in relation to and arising out of such participation in the Awards and footage thereof, which shall include trade publications, press releases, electronic posting to the Website, the website in any display format selected by Kadmus during the Awards or use by KADMUS as it deems fit. In the event of any claims of any nature whatsoever , then Participants shall be solely responsible and liable for the same and shall indemnify Kadmus and/or Kadmus Partners

  • The Awards Management reserves the right to, at its discretion, withdraw or amend or add to the terms & conditions of the Awards at any time, with prospective or retrospective effect, and does not take responsibility for any loss or damage that any individual or organization may suffer as a result of participating or attempting to participate in the Awards, the Awards being withdrawn or its Terms amended.

  • Should a Participant wish to withdraw from the Awards, kindly inform Awards Management in writing at any time up to one week prior to the closure of the call for entry process

  • All disputes relating to or arising out of the Awards shall be subject to the laws of India, and shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction at Mumbai, India.

  • The Participants indemnify Kadmus, its employees, officers, contractors, partner or other persons used by them in relation to this Awards and hold them harmless against any loss, claim, demands, costs, damages, judgments, expenses or liability (including legal costs) arising out of or in connection with any or all claims, that may be brought against the Awards Management by any third party in connection with the Participants participation in or winning the Awards, which is inconsistent with any of the warranties and representations made by the Participants, or due to breach of these Terms and shall reimburse KADMUS for any loss, costs, expense, or damage to which said indemnity applies. Kadmus shall give the Participant prompt written notice of any claim or actions covered by this indemnity, and the Participant shall have the right, at its own expense, to participate in any such action.

  • Decision of Awards Management on all matters is final and binding on all Participants and no correspondence will be entertained on the same.

  • In the event these Terms do not cover any question or complaint in relation to the Awards, the same will be concluded on by the Awards Management (for all other issues) or an independent body or legal team as appointed by the Awards Management and deemed necessary.

  • The Participant agrees to give full consent unconditionally for Kadmus to share any information provided by the Participant with agencies working with them with regards to the program, its recording and broadcasting and related activities including agencies involved with Kadmus

  • The decision of Kadmus in relation to the interpretation of any of these Terms shall be final and binding on the participants.

  • The website is only an informational website www.webfareawards.com for the Awards. Kadmus or its subsidiaries or holding entities are not liable or responsible for any action or decision taken by Participant or anyone acting on Participant’s behalf or under Participant employment or under contract with Participant. Kadmus shall not be under any obligation to Participant and Participant shall have no obligation or rights in relation to the Awards and shall have no claims whatsoever against the Kadmus relating to the selection process or the running of the Awards.

  • If Participants are unclear as to the Terms or any element of the Awards or have any queries/concerns pertaining to the Awards, they can write in with their questions, concerns or queries to the following address:

Award

  • In case an Award is unclaimed by the winner due to any reason the same will result in forfeiture of the Award by such Winner and Kadmus shall not entertain any claims in this regard thereafter.

  • Award is not transferable or assignable and shall not be assigned to any other person. There is no cash substitution, cash redemption or cash value in lieu of the respective Award.

  • Kadmus gives no warranty and shall not be liable for the quality, warranty or replacement of the Award. All taxes, levies and charges relating to the Awards, if any will be borne by the Winners.

General Terms

  • Kadmus shall not be held accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Awards or final gratification or any part of its processes or public voting due to factors beyond its control and/or due to Force Majeure reasons.

  • Kadmus can and shall hold the Participant responsible for any false or misleading information that you may propagate or for any misleading or malfeasance statements in relation to or outside the scope of the Awards, in any manner whatsoever.

  • Kadmus’s decision on any dispute in relation to the Awards shall be final and binding on the participant. Kadmus shall not entertain any questions, enquiries in respect of the selection, shortlisting of the Applications or the Winners or the Awards from any party whatsoever.

  • Kadmus , its directors, employees, affiliates, agents and representatives shall not be responsible or liable for (i) any SMS message delivery failures; (ii) for any SPAM generated messages; (iii) failure or malfunction of any telephone network and/or transmission line, computer servers or equipment, hardware or software or for any lost or unavailable network connections or for failure or for lost, incomplete, delayed or garbled data transmission or any combination thereof; (v) for any injury, loss or damage caused to the Participant or any third party due to the Participant’s participation in this Awards.

  • Kadmus has no obligation to screen an Application, Entry, Nominations or Entry/Candidate Material, information, data, in advance, and is not responsible for monitoring Entries/Nominations received for the Awards, to prevent violation of intellectual property ownership rights, or violations of any law, rule or regulation. If Kadmus is notified of submissions or materials that allegedly do not conform to the Terms, it may investigate the allegation and determine in good faith and in its sole discretion whether to eliminate an Entry/Nomination from the Awards.

  • Participants warrants and represents to Kadmus that all information including any communications, software, photos, text, video, graphics, music, sounds, images and other material submitted by the Participants for the Awards including along with the Application (Information) are solely owned, controlled by the Participants or are provided with the express authority of the applicable owner(s) and do not infringe upon any other individual or organizational rights (including, without limitation, intellectual property rights). Participant shall be completely responsible for handling any infringement or alleged infringement and shall indemnify and hold harmless Kadmus from any claims, costs or damages from infringement or alleged infringement of the logo or trademark or the defense of a claim or any costs payable thereof.

Website

The website is only an informational website www.webfareawards.com (the “Website”) for the Awards. Kadmus and/or Kadmus’s Partners are not liable or responsible for any action or decision taken by Participant or anyone acting on Participant’s behalf or under Participant employment or under contract with Participant. Kadmus shall not be under any obligation to Participant and Participant shall have no obligation or rights in relation to the Awards and shall have no claims whatsoever against Kadmus relating to the selection process or the running of the Awards.

Kadmus shall not be responsible for:

  • any delivery, failures relating to the registration or uploading videos/presentations;

  • any SPAM generated messages as result of Participant accessing the Website;

  • Awards Management not receiving or rejecting any data;

  • any lost, late or misdirected computer transmission or network, electronic failures of any kind or any failure to receive entries owing to transmission failures or due to any technical reasons and

  • Other conditions/situations or failures beyond its control.
